Draft — legal check required

DRAFT — this text needs a legal check before launch. It is not a final privacy policy, terms of use, imprint, or data processing agreement.

1. The service

ARK Tech & Logistics provides Testiy Recruit, a hiring desk at https://recruit.testiy.com. European employers and recruitment agencies use it to post jobs, browse agency-managed candidates, chat, send offers, and pay a placement fee when a work contract is signed. Indian sending agencies use it to represent candidates, recommend them for live jobs, and support chats.

Testiy is not an embassy, not a recruitment agency, and not a law firm. Testiy does not guarantee a hire, a visa, or a work permit. Community on www.testiy.com is a separate product; Recruit accounts do not have Community access.

2. Accounts

You must be 18 or over and able to bind the organisation you represent. Provide accurate organisation details and keep them updated. You are responsible for users who sign in as your organisation, for protecting login credentials, and for turning on two-factor login if you handle candidate documents.

Testiy reviews each organisation before it can fully use the desk. We may ask for more documents, pause posting, or refuse an account where KYC, licensing, or fraud checks fail.

3. Jobs, candidates, and chats

Jobs stay in review until Testiy publishes them. Employers must describe roles truthfully. Agencies must only link candidates they are authorised to represent and must keep candidate files accurate.

Hiring conversations, document requests, and offers must stay on Testiy. Do not move them to email, WhatsApp, or another app. The candidate’s linked Indian agency can read the chat. Contact details stay masked until the candidate signs your offer on Testiy.

Documents shared in chat are for assessing that candidate for that job. Do not download more than you need and do not share files outside Testiy.

4. Fees and invoices

There is no sign-up fee. The placement fee is due only when a work contract is signed on Testiy. The fee for an employer account is the amount Testiy has recorded for that account: a fixed fee, or a number of months of the candidate’s gross monthly salary as shown on the signed offer. You can read the fee that applies to your account in Settings (read-only).

Testiy issues a placement-fee invoice after the offer is signed. The invoice is typically due seven days after the candidate’s arrival, unless the invoice says otherwise. Arrival can be confirmed by the employer or the candidate. If a visa is refused or the candidate does not arrive, you may request a credit note from the hiring chat. Paid invoices cannot be cancelled from the desk.

5. Acceptable use

You must not: scrape or bulk-export candidate data; contact candidates off-platform to avoid the fee; upload falsified licences or identity documents; post jobs you cannot lawfully fill; or use Recruit to discriminate on grounds prohibited by applicable law.

6. Data protection

Our draft Privacy Policy describes how Testiy processes personal data. Employers and agencies are responsible for their own GDPR/DPDP obligations when they review candidates. A draft Data Processing Agreement is available in Settings and needs a legal check before you rely on it.

7. Availability and liability

We aim to keep Recruit available but do not warrant uninterrupted service. To the maximum extent permitted by mandatory law, Testiy is not liable for visa refusals, failed placements, or indirect loss. Nothing in these draft terms limits liability that cannot be limited by law.

8. Suspension and closure

You may request account deletion in Settings. We do not delete data immediately; staff handle the request. We may suspend or close an account for breach, unpaid invoices, fraud risk, or legal requirement.

9. Governing law

These draft terms are intended to be governed by the laws of India, without prejudice to mandatory protections that apply to EU customers (including consumer and data-protection rules that cannot be waived). The final governing-law and venue clause needs a legal check.

10. Changes

Last updated 29 October 2026. Continued use after a reviewed version is published constitutes acceptance of that version, except where mandatory law requires a different process.
